$11,000 Fine, Arrest Possible For Some Who Refuse Airport Scans and Pat Downs

If you don’t want to pass through an airport scanner that allows security agents to see an image of your naked body or to undergo the alternative, a thorough manual search, you may have to find another way to travel this holiday season.

The Transportation Security Administration (TSA) is warning that any would-be commercial airline passenger who enters an airport checkpoint and then refuses to undergo the method of inspection designated by TSA will not be allowed to fly and also will not be permitted to simply leave the airport.

That person will have to remain on the premises to be questioned by the TSA and possibly by local law enforcement.

Anyone refusing faces fines up to $11,000 and possible arrest.


“Once a person submits to the screening process, they can not just decide to leave that process,” says Sari Koshetz, regional TSA spokesperson, based in Miami.


Koshetz said such passengers would be questioned “until it is determined that they don’t pose a threat” to the public.

But Barbera said that if a person is judged to be a possible threat, deputies are legally permitted to detain and search that individual. "The deputies will do it at the airport just as they would do it anywhere else," she said.

Once cleared by the TSA and deputies, the people will be allowed to leave, she said.

Meanwhile, the American Civil Liberties Union was urging Americans to petition the Department of Homeland Security, which oversees the TSA, to change the new policies.

"All of us have a right to travel without such crude invasions of our privacy," the ACLU said in a statement. "Tell DHS Secretary Janet Napolitano to put in place security measures that respect passengers' privacy rights. You shouldn't have to check your rights when you check your luggage."


The ACLU outlined ways for citizens to respond to TSA demands at checkpoints and also provided a form letter for filing complaints.


But the TSA stuck to its guns. Testifying before Congress Wednesday, TSA Administrator John S. Pistole said inspectors at the nation's airports would enforce the new policies despite complaints that the search methods are too invasive.


"We have to ensure that each person getting on every flight is secure," Pistole said.


In March, the TSA introduced AIT scanners -- also known as "nude body" or "whole body' scanners -- and now uses them in more than 60 airports.

How can they do this? How can they make up their own law and fine without going through Congress. Can federal agencies just make up their own laws and fines? What ever happened to legislatures and courts?

I'm glad the DoJ refused to let these idiots have arrest/gun authority like real police when they were formed... the abuses now would be even worse and possible fatal if they had it now.

good question BobF, no due process, thats a bunch of violations of the Constitution, but nobody seems to care. Punishment without even being charged, you are denied the right to change your mind, it seems to me we have reached the tipping point.

This is very scary top me. What if for some reason a person does not pass the first part, it could be anything even a TSA jerk wanting to do the body search thing on purpose for his/her own reasons. Then we say no way and want to leave and we can't????? If we do we are fined if they feel like it?

Meanwhile no profiles done no way that would not be PC.

Let’s face it the security procedures at the nations airports are FUBAR.. But putting
Mall Cops in their place will only make it worse. I say mall cops because that is what
95% of private security tends to be, unless you go with Black Water or companies like
them.. Accountability is almost nonexistent. TSA Has 60,000 employees making 100-K
or better and to many people standing around with their finger up their arse..2years
ago I was in Auckland New Zealand and the security people helped people with the trays and helped load the trays also it ran smooth as a baby’s bottom.. I think we could
benefit by using the Israelis methods and that includes profiling and the hell with the
ACLU and CAIR.. Right now al Qaeda is laughing their ass off and biding their time…
Another mistake we have made is to think of these people as nothing but a bunch of
Cave dwellers and nothing could be further from the truth, among the upper echelon
Are Engineers, scientist, Doctors and other highly educated people many educated right
here in America and England.. Right now we are on the defensive and that is wrong.
Thank you Fearless Leader! We need to be as proactive as the Israelis and if we step on
Some toes, well that is just to damn bad,, At the same time it’s better than say 4-5000 dead Americans in New York, LA or Miami …
